Social Media Terms of Use

By responding #YesRubiynDrywall you agree to the following Social Media Terms of Use:

You hereby grant RubinyDrywall LLC, . and its franchisees, affiliates, assigns, and licensees (individually and collectively, “RubinyDrywall LLC”) a non-exclusive, perpetual, royalty-free, irrevocable, transferrable, sublicensable (through multiple tiers) right and worldwide license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform publicly, and publicly display for all or any purposes whatsoever, your comment(s) and photographs posted to social media platforms, whether now known or later developed (e.g., Facebook, Instagram, Pinterest, TikTok) (collectively, “Social Media Platforms”) tagged with the hashtag #RubinyDrywall LLC or similar hashtags referencing RubinyDrywall LLC  in an identifiable manner, or in relation to which you have responded #YesRubinyDrywall (your “User Content”), in any form, media, or technology now known or hereafter developed, including but not limited to the Internet (such as social media channels, blogs, RubinyDrywall LLC-related websites), mobile applications, gaming platforms, and press releases. You also hereby grant RubinyDrywall LLC the right to use your name and likeness solely as necessary to exercise the foregoing license rights.

You acknowledge and agree that RubinyDrywall LLC’ use of your User Content is entirely at RubinyDrywall LLC’ discretion and RubinyDrywall LLC may cease use of it at any time.

You hereby represent and warrant that: (i) you exclusively own all right, title and interest in and to your User Content and have all necessary rights and authority to grant RubinyDrywall LLC the license granted herein; (ii) your User Content does not infringe, misappropriate, or violate any third party’s intellectual property rights or rights of publicity or privacy, or violate any applicable law or regulation; and (iii) RubinyDrywall LLC’ use of your User Content will not infringe any third party’s intellectual property rights, or rights of publicity or privacy, or violate any applicable law or regulation.

You hereby release, discharge, and agree to indemnify and hold harmless RubinyDrywall LLCand its officers, directors, and employees, from all actions, claims, damages, liabilities, costs and expenses arising out of RubinyDrywall LLC’ use of your User Content.

By permitting RubinyDrywall LLC to use your User Content, you consent to RubinyDrywall LLCprocessing any personal data contained within it as well as your social media handle. If you delete your #YESRubinyDrywall LLC approval post or your User Content from any Social Media Platform, your agreement to these Social Media Terms of Use is still binding.

These Social Media Terms of Use will be governed and interpreted pursuant to the laws of the Commonwealth of Pennsylvania, notwithstanding any conflicts of law. You specifically consent to personal jurisdiction in Pennsylvania in connection with any dispute between you and RubinyDrywall LLC.
